CONTENT GUIDELINES AND PROHIBITED CONDUCT ON THE BREEMFY PLATFORM

This Guide is part of the Terms and Conditions of Use of BREEMFY and its compliance is mandatory for all Users. Its purpose is to ensure a safe, truthful, transparent, and respectful environment for everyone.

# Purpose of this Guide

BREEMFY is a platform for commercial experience intermediation and authentic content creation by Advertisers. This Guide outlines:

  • Which content is allowed and which is prohibited;
  • Which behaviors are unacceptable by any user;
  • Possible disciplinary measures for violations;
  • The notification and review procedures.

# Prohibited Content

Advertisers may not publish content that, in the judgment of BREEMFY or according to applicable law, is considered:

a. Illegal or unlawful

  • Content that promotes illegal activities, incites crime, or violates current regulations.
  • Posts that infringe third-party intellectual or industrial property rights.

b. False or misleading

  • Fabricated experiences, fake reviews, or content published without having actually experienced it.
  • Manipulated content intended to gain fraudulent benefits.

c. Violent or dangerous

  • Incitement to violence, glorification of suicide or self-harm, or any direct or indirect threat.

d. Discriminatory or hateful

  • Comments or images promoting racism, sexism, xenophobia, homophobia, or any form of discrimination.

e. Explicitly sexual or vulgar

  • Images or descriptions of explicit sexual nature, pornography, non-consensual nudity, or offensive language.

f. Privacy and personal data

  • Posts that include personal data of third parties without their consent (full names, addresses, phone numbers, etc.).

# Prohibited Conduct

Both Advertisers and Commercial Users must refrain from:

a. Monetization manipulation

  • Creating multiple accounts to fraudulently accumulate rewards.
  • Posting fake experiences to boost the visibility of a Commercial User.
  • Sharing, selling, or trading rewards outside the Platform.

b. Impersonation or fake identity

  • Creating fake profiles or using someone else's identity to participate on the Platform.

c. Harassment or intimidation

  • Harassing other users through messages, posts, or threats.

d. Spam or automated use

  • Repeatedly posting irrelevant or automated content for promotional or disruptive purposes.

e. Circumventing disciplinary measures

  • Creating new accounts after being sanctioned or banned.

# Expected Ethical Behavior

BREEMFY expects its users to:

  • Truthfulness: Experiences posted should reflect real events.
  • Respect: Interactions should be polite, cordial, and not offensive.
  • Collaboration: Report potential abuse or illegal content through proper channels.

# Moderation and Disciplinary Measures

BREEMFY adopts a model of limited responsibility as a content hosting service provider, in accordance with Regulation (EU) 2022/2065 on Digital Services ("DSA") and the case law of the Court of Justice of the European Union ("CJEU").

5.1 Limited supervision and due diligence

BREEMFY does not exercise systematic prior control over content published by Advertisers or Commercial Users, in line with CJEU doctrine (C-324/09, L'Oréal v. eBay), which prohibits a general obligation to monitor content.

However, BREEMFY:

  • Will act swiftly upon obtaining actual knowledge of illegal content (C-18/18, Glawischnig-Piesczek v. Facebook);
  • Will assess reported content diligently, proportionally, and with justification;
  • Will take proportional action against repeated or serious violations, including content removal, account suspension, profile reopening blocks, and, where applicable, fund withholding.

5.2 Automated measures and human review

BREEMFY may use technological tools to detect potential violations, always respecting users' fundamental rights, including freedom of expression and data protection.

Any automated decision significantly impacting user rights (e.g., account suspension or content removal) may be appealed through human review.

5.3 Notification of illegal content

In accordance with Article 16 of the DSA and European case law, BREEMFY provides users with accessible mechanisms to report content, which will be reviewed without undue delay.

# Notification Procedure and Review

Any user may report inappropriate content through the channel provided on the Platform or via email: admin@breemfy.com.

Reports must be reasoned and documented, and include:

  • Link to the reported content;
  • Reason for the report;
  • Additional evidence, if applicable.

BREEMFY will review reports promptly and take appropriate action in accordance with applicable regulations, particularly the Digital Services Regulation (DSA).

# Guide Review

This Guide may be updated by BREEMFY at any time. Relevant changes will be communicated in due course. Continued use of the Platform implies acceptance of its updates.

# European Legal Framework and User Protection

BREEMFY guarantees its users:

  • The effective application of principles established by the Court of Justice of the European Union regarding digital intermediaries;
  • Respect for fundamental rights enshrined in the EU Charter of Fundamental Rights, especially regarding:
    • freedom of expression,
    • personal data protection,
    • and effective judicial protection.

Users affected by moderation decisions may request a review, provide evidence or correct information, and, if applicable, resort to the appeal mechanisms provided by the Platform.
